Terms of delivery and sale - Consumers

 

1. General
These terms of sale are applicable when you purchase from Convena Distribution A/S as a consumer.


When you purchase as a consumer, you are confirming that you are not purchasing the goods as a trader and that you are not purchasing the goods with a view to selling them.


These terms of sale together with the order confirmation constitute the total contractual basis for your purchase.

 

In these terms of delivery and sale, the “seller” is:

2. Ordering goods
We draw your attention to the fact that your placing of an order is not a legally binding agreement with the seller. Thus the seller is only bound by the purchase agreement when you have received an order confirmation from the seller.
However, regardless of whether you have received an order confirmation, we reserve the right to cancel your order in the event that the item is out of stock or due to delivery failure, technical issues or similar situations.
When you have received an order confirmation, you should check that this matches your order.

 

3. Prices
Unless stated otherwise, all prices are specified in Danish kroner and include VAT.
All charges for shipping, packaging and delivery will be paid in addition to the price for the item. You were notified of these costs when you placed your order.

 

4. Delivery
Delivery is normally expected to take place 3-5 working days after we have sent the order confirmation.
The specified delivery time is the expected delivery time, and a longer delivery time and delays may occur, particularly if the item is not in stock at Convena Distribution A/S. If your delivery is delayed, we will notify you of this as soon as we are made aware of the delay.

 

5. Special information on software products
Many producers of computer software and similar products reserve copyright and other rights to their products. The seller only transfers the rights that the seller has acquired from the seller’s supplier. All software products must be used in compliance with the producer’s instructions and rights.

 

6. Complaints
Complaints relating to any defects may be submitted in compliance with the regulations on consumer purchases in the Danish Sale of Goods Act (købeloven).
Therefore, you have 24 months in which to submit a complaint if a purchased item suffers from a defect.
However, you must always submit your complaint within a reasonable time after having discovered the product defect.
If your complaint is not submitted within a reasonable time after having discovered the product defect, the seller reserves the right to reject the complaint.
The seller is not liable for indirect or derivative losses to the purchaser in the event of complaints result-ing from delays or defects in the goods sold.

 

7. Product liability
The seller’s product liability is limited to the product liability arising from mandatory rules in the Danish Products Liability Act (lov om produktansvar). The seller has no product liability apart from this.

 

8. Personal data
Personal data is understood to mean any form of information on an identified or identifiable person.
By ordering goods, you accept that the seller will record and process your personal data in compliance with the rules and principles stated on our website.

 

9. Right to cancel
You have a right to withdraw from this agreement within 14 days without stating reasons.
This right to cancel will expire 14 days after the date on which you or a third party specified by you, but not the carrier, take physical possession of the goods.

This message must be an unambiguous declaration that you wish to exercise your right to cancel.
You may choose to use the enclosed standard cancellation form, but you do not have to do so.
The cancellation deadline is met if you send your message concerning the exercising of your right to can-cel before the expiry of the cancellation deadline.

 

Consequences of cancellation
If you exercise your right to cancel, we will refund all payments received from you, including delivery costs (but not additional costs as a consequence of your own choice of a delivery method other than the cheapest form of standard delivery that we offer), without undue delay and in any case no more than 14 days from the date on which we received your notification stating that you wish to cancel the purchase. Any such refund will be made by the same payment method that you used for the original transaction, unless you have specifically consented otherwise. In any case, you will not be charged fees in any form as a consequence of the refund.

We may withhold your refund until we have received the returned goods or you have provided documen-tation indicating that you have returned the goods, depending on which arrives first.


You must return the goods or deliver them to us without undue delay and no later than 14 days from the date on which you notified us that you would be exercising the right to cancel as stated in the agreement. This deadline will be met if you return the goods before the end of the 14 days. You personally bear the risk for the goods until we have received them back.
You must bear the direct cost of returning the goods.


You will only be liable for any reduction in the value of the goods due to handling other than what is necessary to determine the nature of the goods, their properties and the manner in which they operate.

 

10. Disputes
The purchase is subject to Danish law in all respects. Any dispute arising from the order and any claim between the parties relating to or arising from the purchase must be settled by the Danish courts. Convena Distribution A/S’ jurisdiction (Glostrup district court) has been agreed as the legal venue. However, Convena Distribution A/S will also be entitled to bring any cases at the consumer’s legal venue.
